When a Florida property is sold at a foreclosure auction or tax deed sale, the sale price sometimes exceeds the total amount owed — the mortgage, back taxes, legal fees, and other costs. The money left over after those debts are satisfied is called surplus funds, excess funds, or excess proceeds.

These funds do not belong to the lender or the county. They belong to the former property owner or their heirs. Until they are claimed, the money sits in the county court registry — and claims are time-sensitive, so it is important to act promptly.
